High Court strikes AG’s appeal against AWDC With Costs

The High Court in Gulu has dismissed an appeal by the Attorney General due to procedural errors. The appeal, registered under number 224 of 2022 by Ms Reeve Advocates & Solicitors, was filed against a ruling by the Deputy Registrar of the High Court.

Justice Phillip Odoki ruled that the concerns raised by AG were without merit. He highlighted that the appeal was filed out of time and without the required leave from the court, leading to its striking out on 9 July 2024. This decision marks a significant setback for AG in their legal pursuit.

The case dates back to 2006, when Adyera Nobert and others sought permission to represent 1,700 individuals in a lawsuit against the Attorney General. The claimants have been seeking compensation for losses incurred.

Mr Rubangakene Bosco, the finance representative of Acholi War Debt Claimant Association (AWDCA) attributed the procedural issues to politics and corruption. He expressed hope for further court hearings, suggesting that the association may continue to seek justice through other legal avenues.

The court’s decision includes costs to the respondents, adding a financial burden to AG’s ongoing legal efforts. This ruling emphasises the importance of adhering to procedural requirements in legal appeals.
