The High Court judge in Kitgum district has said they have implemented policy to survay any land related matters brought court for hearing
His Lordship Justice Mwaka Philip Wilebrod said many of the cases before the court involve land disputes, with most complainants being elderly people. He noted that some cases have delayed because of lack of proper evidence from complainants to prove ownership of the land.
Justice Mwaka said brothers and sisters are now fighting and even killing one another over land matters, yet elders who are supposed to mediate and guide families on boundary issues often lack clear knowledge about the actual land boundaries.
He added that some people claim ownership of large pieces of land measuring over 1,000 acres, while others dispute even small portions of land, something he said creates a heavy burden for judges when determining such cases.
The judge emphasized that before any land case is heard in court, the land must first be surveyed to help establish the correct boundaries and also the best way if some one have appeal to the court over land must write to court as the best way of handling
Justice Mwaka also called upon communities to resolve land disputes at family and community level before taking matters to court, saying not every disagreement should end up in court.
